BANKRUPTCY

Creditor Representation: We represent a variety of creditors, such as creditors' committees involving major bankruptcy cases on the West Coast, in all types of bankruptcy cases. Our attorneys have experience at obtaining relief from the automatic stay, negotiating the terms for agreements for adequate protection and the use of cash collateral and obtaining the appropriate treatment of leases and executory contracts. In addition, we service our clients through negotiating terms for appropriate treatment in bankruptcy plans, litigating the determination of the dischargeability of debts, defending creditors against avoidance actions, and other actions necessary to assure that our bankruptcy case clients receive the best possible outcome.

Trustee Representation: As a result of our firm earning a solid reputation with bankruptcy trustees throughout the West Coast, Bullivant regularly represents trustees in Chapter 7 and Chapter 11 cases. In the course of these engagements, the firm provides the full range of services required by a trustee. Services include advice on the duties and powers of a trustee, the prosecution of avoidance actions, the negotiation and documentation of the sales of assets from the bankruptcy estate, and compliance with all bankruptcy rules and procedures.

Debtor Representation: We represent Chapter 11 debtors, and occasionally, debtors seeking relief under Chapter 7. Our adept attorneys organize and execute individual and corporate reorganizations under the Bankruptcy Code. These services require our attorneys to negotiate and document disclosure statements and plans, as well as represent the debtor in all facets of the case.

INSOLVENCY / FINANCIAL WORKOUTS

We have extensive experience in structuring and advising both creditors and debtors in problem loan workouts, out-of-court creditor compositions, assignments for the benefit of creditors, and receiverships.

Distinct from the bankruptcy services of the firm, our attorneys are skilled in all areas of creditors' rights. Clients of Bullivant include various financial institutions, insurance companies, leasing and finance companies, and other entities interested in preserving and enforcing their rights as creditors.
