Bryana Blessinger, a civil litigator in Oregon and Washington, handles complex first and third party insurance coverage matters including extra-contractual bad faith claims, property loss, directors and officers (D&O), professional negligence, product defect, and crime coverage. Bryana also defends general tort actions, with an emphasis on property loss, professional malpractice, and employment law claims.
Throughout her career, Bryana has tried more than 30 jury and bench cases, including the successful defense of a $1 million first-party property claim by a wholesale automotive parts distributor for alleged damage to inventory. Bryana provides coverage opinions and analysis, as well as representation through all stages of litigation, including case analysis, discovery, and pre-trial strategy. She has arbitrated and mediated numerous cases with favorable outcomes for the client, including a multi-day arbitration resulting in a defense verdict for a real estate agent client.
Bryana also understands the risks of taking cases to trial or arbitration. She works to bring many cases to conclusion through successful motion practice in state and federal courts, sparing the cost of trying a case, but achieving the desired outcome. That includes a successful Motion for Summary Judgment (MSJ) in an $11 million construction defect lawsuit, where she successfully obtained dismissal of all claims against a general contractor. Prior to private practice, Bryana was a Deputy District Attorney for Washington County. She draws on that legal experience, where she tried many criminal cases to verdict.
Bryana has also handled large-scale environmental coverage matters, including matters involving Oregon's Portland Harbor Superfund Site. She also has an understanding of EPA, Oregon DEQ, and Natural Resource Damage remedial investigations and feasibility studies.
Bryana presents programs on insurance coverage to professional legal associations and clients and has published numerous articles on the topic. Bryana is actively involved in the Defense Research Institute (DRI), serving as an Editor-in-Chief for The Voice, the Vice-Chair of the Insurance Law Committee's Directors and Officers Substantive Law Group, and the Publications Co-Vice Chair of the Young Lawyers Committee.
