Veterans Benefits Improvement Act ("VBIA") makes two critical changes for employers

In December 2004, President Bush signed the Veterans Benefits Improvement Act ("VBIA"), making two critical changes to the Uniformed Services Employment and Reemployment Rights Act of 1994 ("USERRA"). These changes impact employers with employees absent due to military service. First, VBIA expands the period for which employers must provide employees in military service the option of maintaining employer sponsored health insurance coverage by six months (from 18 months to two years). Second, VBIA requires employers to post a notice to employees of their benefits, duties, and rights under USERRA/VBIA.
Although employers may post their own notices to employees stating reemployment rights, anti-discrimination and anti-retaliation freedoms, benefit protections, and enforcement obligations, the U.S. Department of Labor has released a model notice. This posting requirement is effective immediately. Employers should display the new poster or notice in the same location as other required posters and notices.
