Secured a judgment of $9.977 million for our client under a counterclaim for first-party insurance fraud. Following a two month jury trial in an Oregon state court, the jury returned a verdict finding that the insured made materially false representations regarding the quality and cost of dwelling components. The court ruled that the intentional misrepresentations voided the insured’s claims under the insurance contract, and entitled the insurer to return of almost $10 million paid in reliance upon the misrepresentations.
