We represented a property insurer who was sued for bad faith in Idaho in connection with a property loss that happened in British Columbia, Canada. We filed and won a motion for summary judgment on the bad faith claims, which the court granted finding that our client’s claim decision had been “fairly debatable,” and thus not in bad faith. The court also granted our motion for summary judgement on punitive damages. As a result of this ruling, the policyholder dismissed the remainder of his claims without payment.
