In a first-impression matter in Oregon, Bullivant represented a hospital charged with multiple counts of improper disposal of infectious waste in a county landfill, and was assessed a large fine by the Oregon DEQ. The fine was accompanied by negative local press coverage. Through an immediate investigation, assessment of the allegations, and game plans for both an appeal and settlement negotiations, we were able to achieve a settlement with the DEQ for a substantial reduction in the original fine. The settlement included a Supplemental Environmental Project, which allowed most of the reduced amount of the fine to be spent on local programs for bicycle commuting and food recovery, which had a positive impact on health and the environment and generated positive news for the hospital.
