Bullivant Houser Bailey has represented buyers and sellers in many real estate transactions involving contaminated property. Generally, the issues have included quantifying risk to make a sell/buy decision based on economic factors. Properties have included former dry cleaning sites, former gas stations, former auto repair shops, agricultural areas with pesticide/herbicide issues, and other sites with contamination from historical operations. Often our work on these site includes evaluating and/or obtaining regulatory closure, for example thru the Voluntary Cleanup program and NFA determinations.
