Secured a unanimous defense verdict in an Idaho federal court case in which the insureds attempted to prove that a vacancy clause in a commercial property policy issued by Travelers was not applicable. At stake was a $500,000 claim by Wild Waters, a water park in Coeur d’Alene, Idaho, for a 2011 vandalism and theft incident. In addition to arguing that the Vacancy provision did not apply, the insureds argued that Travelers had waived, or should be estopped to assert, the Vacancy provision.
