Water Park Gets No Insurance Recovery after Jury Returns Unanimous Verdict in Idaho Federal Court Case

Ron Clark and Matt Hedberg received a verdict in an Idaho federal court case in which the insureds attempted to prove that a vacancy clause in a commercial property policy issued by Travelers was not applicable. The jury returned a unanimous verdict that Travelers owed no coverage to the bankrupt Coeur d’Alene water park that was vacant when it was vandalized, and that Travelers was not precluded from enforcing the vacancy provision due to actions or statements by the independent insurance agent.
